RotatingProxies.com is an anonymous online browsing service (the “Service”). The following terms and conditions (the "Acceptable Use Policy" or “Acceptable Use Policies” or “AUP”) form a binding agreement between you and us. The terms "RotatingProxies", "us", "we", "our" or "Provider" refers to RotatingProxies.com who, in conjunction with its affiliated companies, offers the Services (as defined below). The term "you" or "your" refers to the person accessing or using the Site and Services, or RotatingProxies or organization on whose behalf that person accesses the Site and Services.
1.1 Prohibited Use. You may use our Service only for lawful purposes. Including, but not limited to the following, you may not use our Service to: post any information that is abusive, threatening, obscene, defamatory, libelous, or racially, sexually, religiously, or otherwise objectionable and offensive; use the service for any unlawful purpose or for the promotion of illegal activities; attempt to, or harass, abuse or harm another person or group; use another user’s account without permission; provide false or inaccurate information when registering an account; interfere or attempt to interfere with the proper functioning of the Service; publish or link to malicious content intended to damage or disrupt another user’s browser or computer; to upload, post, email or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party; to upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," or "pyramid schemes”; to engage in the promotion, offer, or sale of interests in illegal financial or “ponzi" schemes; to interfere with or disrupt our Site's system or servers or networks connected to our Site's system, or disobey any requirements, procedures, policies or regulations of networks connected to our Site's system; to collect or store personal data about other users without their knowledge; to promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty; or to view, promote, or engage in any activity relating to child pornography, and violation of laws relating thereto, which includes without limitation, Prosecutorial Remedies and Other Tools to end the Exploitation of Children Today Act, the Child Online Protection Act, Communications Decency Act of 1996, and Children’s Internet Protection Act, all as amended.
1.2 User Content. You agree not to use the Services for illegal, harmful, misleading, fraudulent or other malicious purposes or to post, disseminate or communicate any unlawful, defamatory, obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter or for the transmission of material that contains viruses or other malicious code, or that which infringes or may infringe intellectual property or other rights of another. You agree not to use the Services for the transmission of "junk mail", "spam", "chain letters", "phishing" or unsolicited mass distribution of email.
1.3 Violation Claims. Any Claim of Violation of this AUP that is being submitted by a third party must include the name and contact information of the complaining party, the IP address from which the alleged complaint originated, and a description of the violation. This AUP to all users of servers provided by RotatingProxies, including without limitation the customers, clients and other users of our clients. RotatingProxies reserves the right, at its sole discretion, to refuse new service to any individual, group, or business. RotatingProxies also retains the right to discontinue service for any client for any reason or no reason and at any time, including without limitation for violation of this AUP.
1.4 Disclosure pursuant to Subpoena. RotatingProxies may be required by law to provide Customer’s information pursuant to subpoena issued by a court, governmental entity or otherwise. Information shall be disclosed as directed pursuant to subpoena. Provider shall release information described in the subpoena. If permitted by law, Provider will endeavor, but is not obligated, to notify Customer that it has received a subpoena for records pertaining to Customer.
1.5 Decline of Acceptance of New Customer or Renewal of Services. Provider retains the right, at its sole discretion, to decline acceptance of a potential customer, or refuse to supply additional Services to or renew Services with any Customer.
2.1 Terms of Service. The TOS (found here: https://rotatingproxies.com/terms) are incorporated by reference and made a part hereof.
2.2 Changes to AUP. Customer agrees that Provider, at its sole discretion, may change the terms of this AUP without notice and that Customer shall keep itself informed of Provider’s AUP for any and all changes by reviewing it regularly on Provider’s website at: https://www.rotatingproxies.com/acceptable-use. Customer’s continued use of the Services following such changes constitutes consent to such changes.
2.3 Breach. Any breach of this AUP is a breach of the TOS between Provider and Customer, and subject to immediate termination, without notice, at Provider’s sole discretion.
2.4 Severability. In the event any term or provision in this AUP is found by a tribunal of competent jurisdiction to be invalid, the remainder of this AUP shall remain in full force and effect.
3.1 Headings. Headings are for ease of reference and are not made a part of this AUP.
3.2 Gender. The use of the words “it”, “its”, “he”, “his”, “she”, “hers”, “they”, “theirs” or similar words, shall include the masculine and the feminine, the singular and the plural.
RotatingProxies, at its sole discretion, reserves the right to suspend accounts determined to be engaged in a prohibited use of the Service without prior notice. You understand and agree that any liability, loss or damage that occurs as a result of the use of any User Content that you make available or access through your use of the Service is solely your responsibility. RotatingProxies is not responsible for any public display or misuse of your User Content. RotatingProxies does not, and cannot, pre-screen or monitor all User Content.
